Agreement to Terms

By downloading, installing, or using the EverHabit mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

Description of Service

EverHabit is a habit tracking mobile application designed to help users build and maintain positive habits. The App provides features including:

• Progress tracking and streak monitoring
• Reminder notifications

• Achievement and gamification features

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the App or its related systems

Privacy and Data

Your privacy is important to us. EverHabit is designed with privacy at its core:

• All data is stored locally on your device
• We do not collect, store, or transmit personal information
• No analytics or tracking data is collected
• Your habit data remains private and under your control

User Content and Data

You retain ownership of all data you create within the App, including:

• Habit names, descriptions, and categories
• Completion records and notes
• Custom settings and preferences

You are responsible for backing up your data. While the App includes local data storage, we recommend using iOS backup features to protect your information.

Availability and Updates

We strive to keep the App available and functional, but we do not guarantee:

• Uninterrupted access to the App
• Error-free operation
• Compatibility with all iOS versions or devices
• Continued availability of specific features

We may update the App periodically to improve functionality, fix bugs, or add new features. Updates may be required for continued use.

Intellectual Property

The App and its original content, features, and functionality are owned by EverHabit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content

Limitation of Liability

To the maximum extent permitted by law, EverHabit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or information
• Loss of profits or business opportunities
• Personal injury or property damage
• Any other damages arising from use of the App

Indemnification

You agree to indemnify and hold harmless EverHabit from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

App Store Terms

If you download the App from the Apple App Store, you acknowledge that:

• These Terms are between you and EverHabit, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• Apple is a third-party beneficiary of these Terms

Termination

These Terms remain in effect until terminated by either party. You may terminate by:

• Deleting the App from your device
• Discontinuing use of the App

We may terminate or suspend your access immediately if you breach these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Thailand, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Bangkok, Thailand.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms. Your continued use of the App after changes constitutes acceptance of the new Terms.

Age Requirements

The App is suitable for users of all ages. If you are under 18, you represent that you have obtained parental consent to use the App and agree to these Terms.

We strive to make the App accessible to users with disabilities. The App includes:

• VoiceOver support
• Dynamic Type compatibility
• High contrast support
• Keyboard navigation support
